Who we are
Avery Freight Lines is the trade name of C-NA Worldwide LLC (“AFL,” “we,” “us”), a property broker licensed by the Federal Motor Carrier Safety Administration (USDOT 3990619, MC-1496960), with its office at 11175 Azusa Ct., Suite 110, Rancho Cucamonga, CA 91730. AFL decides how the personal information described in this policy is used and is responsible for it.
Privacy Officer. Our Chief Executive Officer is the person in charge of protecting personal information at AFL. You can reach the Privacy Officer at support@averyfreight.com, at (909) 918-5477, or by mail at the address above.
What this policy covers
This policy covers averyfreight.com (the “Site”) and the personal information you give us through it, or when you call, text or email us, including quote requests, carrier setup requests and the AFL monthly freight update. It explains what we collect, why, who receives it, how long we keep it, and the choices and rights you have. It also covers the people at carriers that ask to work with us and at the carriers we work with, such as owner-operators, dispatchers and drivers, when they set up with us and when we vet a carrier, arrange and track a load and pay for it.
A few things have their own terms:
- Each shipment we arrange is governed by the agreements for that shipment.
- The carriers and partners who perform a shipment follow their own privacy policies.
- The shipment-tracking portal linked from the Site runs on our transportation-management software provider’s platform, under that provider’s terms and privacy policy.
Information we collect
The table sums up each kind of personal information we collect, why we use it, whether it is sold or shared, and how long we keep it. The sections below give the details.
| Information | Why we use it | Sold or shared? | How long we keep it |
|---|---|---|---|
| Contact details Your name, email address and phone number, and your company if you add it; and, when you give them to us, whether that phone is a cell or an office line, a cell number for texts, and how you prefer we reach you (call, text or email). California category: Identifiers; personal information described in Civ. Code 1798.80(e); professional or employment-related information | To prepare your quote, contact you about it, and arrange and document any shipment you book. | No | Three years after our last contact about a request that did not become a shipment; three years after the shipment for shipments we arrange, and longer only while a tax rule, a claim, an audit or a legal hold requires it. |
| Shipment details What you are shipping, how it is packed, its dimensions and weight, whether it can be stacked, and its freight class if you know it; the service you choose; how it must be protected in transit and what you tell us about it, such as a set temperature or temperature range, keep from freezing, keep dry or tarped on an open deck, fragile, food, used goods or worth more than $100,000; your yes or no answer to whether it contains hazardous materials, which for air freight covers dangerous goods such as lithium batteries; when it is ready, how fast it must arrive, any deliver-by date and time, and whether that date is firm; whether it is one load, ongoing freight or a project; for air freight, the reason for the deadline, whether it can ride on its side and, for an international move, who clears customs and the cargo value; for intermodal, whether it is domestic freight, an import or an export, the container size, whether an import is transloaded, a live load or a drop at each door, how many containers and how they move; for warehousing, the services, the kind and amount of space, the locations, any chilled, frozen or alcohol storage, how the goods arrive, how many products (SKUs), orders a month, where the orders go, the systems you need, and whether AFL should also arrange the freight in or out; for heavy haul and data center freight, each large piece’s size and weight and whether there are battery cabinets; for modular homes, how many; any notes you add; and, if you tell us by phone, the freight’s value. California category: Identifiers; commercial information | To prepare an accurate quote, arrange the shipment with a carrier, and prioritize requests by the details you give (a person reviews every one). | No | Same as contact details. |
| Pickup and delivery stops Each pickup and delivery place you pick from our place list (its country, city, region and postal code, or its airport or port) and any extra stops; for each stop, the kind of place, whether it has a loading dock or a forklift (or, for heavy and open-deck freight, how it loads), its shipping or receiving hours, whether it needs an appointment, and the services it needs, such as a liftgate, inside pickup or delivery, a pallet jack, a call before arrival or a weekend pickup; for an inside delivery, the level of service, from curbside to the room you choose, and any stairs, elevator, narrow doors or tight turns; for heavy haul, a crane or rigging crew to arrange; for air freight, whether you bring the freight to the airport or need a pickup at your door, and whether it is collected at the airport or delivered to the door. California category: Identifiers; commercial information | To prepare an accurate quote, plan each pickup and delivery with the carrier, and price the services each stop needs. | No | Same as contact details. |
| Files you attach Spec sheets, drawings and photos you choose to attach to a quote request, up to three PDF, JPEG, PNG, WebP, HEIC or HEIF files. Attaching files is optional. A file can hold personal information, such as names or signatures on a bill of lading, and a photo can hold the place where it was taken (location data stored inside the photo, known as EXIF GPS data). Before sending, the form redraws JPEG, PNG and WebP photos in your browser, which removes that location data. HEIC and HEIF photos and PDFs are sent as they are and can still carry it. California category: Commercial information; and, when a file holds them, identifiers, audio, electronic, visual or similar information, and geolocation data | To prepare your quote and plan the shipment from what the files show. | No | The Site does not store your files. They go only to our quote inbox, attached to your request, and are kept the same as contact details. The provider that delivers the request to our inbox keeps its copy, with the files, for 30 days, stored in the United States. |
| Messages and calls What you tell us when you call, text or email us, including any message left for us. California category: Identifiers; commercial information | To answer you and keep a record of what we agreed. | No | Same as contact details. |
| Consent records Whether you agreed to texts or signed up for the newsletter, the cell number you agreed to receive texts at, the exact words you agreed to, and when. California category: Identifiers; commercial information | To send only what you agreed to, and to show that you agreed. | No | Four years after the last message we send under that consent, or four years after you agreed if we never send one. |
| Device and visit information IP address, browser and device type, the pages you visit, the page that sent you here, and the date and time. California category: Identifiers; internet or other electronic network activity information | To deliver and secure the Site, keep bots out of the quote and carrier setup forms, and count visits without cookies. | No | Server logs: we can see request logs for one day on our hosting plan, and Vercel keeps its own records as its privacy policy describes. Visit counts: Vercel keeps page-view records without a cookie, using a visitor code it discards after 24 hours, and shows us only totals, for 12 months on our plan. |
| Approximate location Your country, region and city, worked out from your IP address. California category: Geolocation data (approximate, never precise) | Site statistics and security. | No | As part of the visit records above. |
| Carrier and driver information For carriers that ask to work with us and the carriers we work with: the MC or USDOT number, company name, and the name, email address and phone number a carrier sends on our carrier setup page; names and contact details of owner-operators, dispatchers and drivers, operating authority, insurance and safety records, payment and tax details (such as a W-9), and the location of a driver’s phone or truck while a load is tracked, through the tracking service the carrier agrees to. California category: Identifiers; personal information described in Civ. Code 1798.80(e); commercial information; professional or employment-related information; geolocation data; sensitive personal information (a Social Security number used as a tax ID, and precise geolocation while a load is tracked) | To set up and vet carriers, send them AFL’s invitation to join on Highway, arrange and track loads, pay for them, and keep the records the law requires. | No | Three years after the last load, or after our last contact about a setup request that did not lead to a load, and longer only while a tax rule, a claim, an audit or a legal hold requires it. |
If you give us the name and phone of the person who hands over or receives the freight, please tell them about this policy first.
Where it comes from
- From you, when you fill in the quote form or the carrier setup form, or call, text or email us.
- Automatically from your browser and device, when you use the Site.
- From the carriers and logistics partners who handle a shipment you book with us, such as pickup and delivery updates.
- From carriers and drivers, and from the carrier-vetting and load-tracking services we use.
Place suggestions
The pickup, delivery and warehouse boxes on the quote form suggest places from a list on our own site, so what you type in them stays on averyfreight.com until you send your request. Place names and postal codes from GeoNames (geonames.org), licensed under CC BY 4.0 (creativecommons.org/licenses/by/4.0), trimmed and reformatted by AFL. UK postcodes contain Royal Mail data © Royal Mail copyright and database right 2022. Airport codes from OurAirports (ourairports.com), released to the public domain.
Sensitive information
The Site does not ask for sensitive personal information, such as Social Security or other government ID numbers, financial account numbers, precise location or health information. The carrier setup page asks for a carrier’s MC or USDOT number, a public registration number that anyone can look up in the FMCSA’s SAFER system. Please leave it out of the quote form, the files you attach and your messages. A photo you attach can carry the precise place it was taken: the form removes it from JPEG, PNG and WebP photos before sending, a HEIC or HEIF photo or a PDF is sent as it is, and we do not use any location stored in a file. For the carriers we work with, we handle tax IDs to pay them and a driver’s phone or truck location while a load is tracked; the California section explains how that is limited.
How we use information
- To answer your quote request and contact you about it by email or phone, or by text if you agree.
- To arrange, manage and document the shipments you request, including giving a carrier the details it needs.
- To send the AFL monthly freight update, if you sign up for it.
- To run, secure and improve the Site, including keeping spam and bots out of the quote and carrier setup forms.
- To set up and vet the carriers we work with, send them AFL’s invitation to join on Highway, arrange and track their loads, and pay them.
- To keep business records and meet our legal, tax and regulatory duties.
- To protect the rights and safety of AFL, our customers and others, and to enforce our terms.
We use personal information only for these purposes, or for purposes compatible with them, and we ask you first before using it for a new purpose that needs your consent.
People at AFL make every decision about your quote, rates and shipments. We prioritize requests by the details you give, and a person reviews every one. Automated security checks run before a request reaches us: Cloudflare Turnstile, our hosting provider’s firewall, a hidden anti-spam field, limits on how many requests arrive from one IP address and in total, and our email provider’s spam screening. They can stop a request that looks automated. If you do not hear back from us about a request you sent, call us at (909) 918-5477 or email support@averyfreight.com, and a member of our team will take your request.
Who receives information
- Carriers and logistics partners receive the details they need to quote, move and deliver a shipment you ask us to arrange, such as the pickup and delivery addresses and contact names.
- Service providers that run parts of the Site and our email receive the information their job needs, and act for AFL under their service agreements:
- Vercel hosts the Site and runs its cookieless visit counts and speed measurements (Vercel Web Analytics and Speed Insights).
- Resend delivers each quote request and carrier setup request from the Site to AFL’s inbox.
- Microsoft 365 runs AFL’s business email, where quote requests, carrier setup requests and messages are received and answered.
- Proofpoint screens email sent to AFL, including quote and carrier setup requests, for spam, phishing and malware before it reaches our inboxes.
- D1 Defend manages AFL’s email security, including the Proofpoint screening, and can see email held for review.
- Business software providers that we use to quote, book, track and bill shipments, such as our transportation management system, accounting software, shipment-tracking and carrier-vetting services, and our text-message provider once texts start, receive the details those jobs need and act for AFL under their service agreements.
- Highway, the carrier setup service AFL uses. When a carrier sends its details on our carrier setup page, AFL gives Highway the email address and MC or USDOT number it needs to send the carrier’s invitation. The carrier then creates its profile on Highway’s own site, under Highway’s own privacy notice, and Highway sends AFL the profile the carrier completes for AFL. Highway also uses what it receives for its own service, as its privacy notice describes. The Site itself passes Highway nothing: the Sign Up on Highway button is a link to Highway’s site.
- Other services that receive information from the quote and carrier setup forms and do not act only for AFL:
- Cloudflare runs Turnstile, the security check that keeps bots out of the quote and carrier setup forms, and reads your IP address and browser details to do it. Cloudflare also uses those signals, as its own controller, to improve Turnstile, and its Turnstile privacy addendum says it does not use them to identify, profile or target anyone.
- Authorities and others, when the law requires it, or when it is needed to protect the rights, property or safety of AFL, our customers or others.
- A buyer or successor, if AFL is involved in a merger, acquisition or sale of assets, with this policy continuing to protect your information.
AFL does not sell personal information. Nor does it share personal information for cross-context behavioral advertising.
In the past 12 months, we have disclosed the categories of information in the table above for business purposes to the carriers, partners and service providers described in this section.
Global Privacy Control and Do Not Track
Global Privacy Control. If your browser sends a Global Privacy Control signal, we treat it as your request to opt out of the sale or sharing of your personal information and of targeted advertising, with no further step needed. It applies to the browser that sends the signal; to opt out everywhere, turn it on in each browser you use or send us a request. Your Privacy Choices shows “Opt-Out Request Honored” when the signal is on. The browsers and extensions that can send the signal are listed at globalprivacycontrol.org.
Do Not Track. Browsers’ Do Not Track setting has no agreed standard, so the Site handles every visit the same way whether or not your browser sends it: optional tools stay off until you turn them on.
Activity across websites. Cloudflare’s security check on the quote and carrier setup forms runs on many websites and uses what it sees there to spot bots. Apart from that check, no company collects information about your activity on the Site over time or across other websites.
Text messages
If you tick the text-message box on the quote form, when the form offers it, AFL may text the cell number you give us for texts about that quote request and the shipments you book with us. These are informational messages only, never marketing. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to texts is not a condition of any purchase. The full terms are in our Text Message Terms.
We never sell, share or provide your mobile number or your text-message opt-in data and consent to third parties or affiliates for marketing or promotional purposes. Your text-message opt-in data and consent stay with AFL and the service providers that run our texting, email and business software for AFL.
How long we keep information
- Quote requests and messages, including any files you attach: three years after our last contact about a request that did not become a shipment, then we delete them. A request that becomes a shipment is kept with that shipment’s records.
- Shipment records: three years after the shipment, as the federal rules for brokers require (49 CFR 371.3), and longer only while a tax rule, a claim, an audit or a legal hold requires it.
- Carrier and driver records: three years after the last load, or after our last contact about a setup request that did not lead to a load, and longer only while a tax rule, a claim, an audit or a legal hold requires it.
- Consent records: four years after the last message we send under that consent, or four years after you agreed if we never send one.
- Email delivery copy: the provider that delivers quote and carrier setup requests to our inbox keeps its copy, with any files attached, for 30 days, stored in the United States.
- Server logs: we can see request logs for one day on our hosting plan, and Vercel keeps its own records as its privacy policy describes.
- Visit counts: Vercel keeps page-view records without a cookie, using a visitor code it discards after 24 hours, and shows us only totals, for 12 months on our plan.
How we protect information
We use reasonable administrative, technical and physical safeguards, including encryption in transit (HTTPS) across the Site, a security check and rate limits on the quote and carrier setup forms, email security screening, and access limited to the people at AFL who need it. No method of sending or storing information is completely secure, so we cannot promise absolute security.
If an incident happens. If a breach of security involving your personal information requires notice under the law that applies to it, we notify you and the authorities that law names, such as a state attorney general, the Office of the Privacy Commissioner of Canada, the Commission d’accès à l’information du Québec or Puerto Rico’s Department of Consumer Affairs (DACO), within the time that law sets. We keep a record of every privacy incident.
Your privacy rights
Privacy laws in California and other U.S. states, in Canada and Quebec, and in Mexico give people rights over their personal information. AFL offers these rights to everyone who uses the Site, wherever they live, subject to the exceptions the law allows:
- Know and access: ask what personal information we hold about you, where it came from, how we use it and who receives it, and get a copy.
- Correct: have inaccurate or incomplete information fixed.
- Delete: have your information deleted, except what the law requires us to keep, such as shipment records, or what we need for purposes the law allows, such as completing a shipment.
- Portability: receive the information you gave us in a structured, commonly used electronic format, or have us send it to an organization the law allows to receive it.
- Opt out: of the sale or sharing of your personal information and of targeted advertising. Your Privacy Choices shows your current choices.
- Withdraw consent: to texts (reply STOP), to the newsletter (the unsubscribe link in every issue), at any time.
- Equal treatment: using any of these rights never affects the service, quotes or rates you receive from AFL, and AFL never retaliates against a job applicant, employee or independent contractor for using them.
How to make a request
Email support@averyfreight.com, call (909) 918-5477, or write to us at 11175 Azusa Ct., Suite 110, Rancho Cucamonga, CA 91730. Tell us which right you want to use and how to reach you.
Confirming it is you. To protect your information, we confirm that a request comes from you, usually by matching details we already hold, such as your email address and the details of your quote request. For a request to see specific pieces of information, we match at least three details we already hold and ask you to sign a statement, under penalty of perjury, that you are the person the information is about. For a request to delete or correct, we may ask for one more detail, depending on the information involved. We use what you give us for this only to check the request, and an opt-out request needs no verification.
Someone acting for you. Someone you authorize can make a request for you with your signed permission. For a request to see, correct or delete information, we may also ask you to confirm your identity with us directly, unless the agent holds a power of attorney. For a request to opt out, your signed permission is enough.
Timing. We confirm that we received your request within 10 business days and answer it within 45 days. If we need more time, we tell you why and answer within 45 more days. Where your law sets a shorter deadline, such as 30 days in Canada or 20 business days in Mexico, we meet it. An opt-out takes effect within 15 business days, and usually straight away.
Cost. Requests are free. If a request is clearly unfounded or excessive, we may decline it or charge a reasonable fee where the law allows, and we will explain why.
Appeals. If we turn down your request, in whole or in part, we explain why, name the legal basis, and tell you which authority you can go to and by when. You can appeal by replying to our answer or by emailing support@averyfreight.com with “Privacy appeal” in the subject line, and we answer the appeal in writing within 45 days. You can also go straight to the attorney general or privacy regulator where you live. Some regulators’ deadlines run from our first answer and keep running during an appeal to us: 30 days in Quebec and 15 business days in Mexico, as the sections below explain.
California residents
- The table under Information we collect is our notice at collection: it lists the categories of personal information we have collected in the past 12 months, with their purposes, whether they are sold or shared, and how long we keep them.
- AFL never sells personal information for money and has no actual knowledge of selling or sharing the personal information of consumers under 16.
- AFL uses sensitive personal information only for the purposes California law allows without a right to limit it, such as tax reporting for the carriers we pay and tracking a load’s location while a driver moves it, and never to infer characteristics about anyone.
- AFL does not disclose personal information to third parties for their own direct marketing purposes. You can ask us about this at support@averyfreight.com.
Nevada residents
AFL does not sell covered information as Nevada law defines it. You can still send an opt-out request to support@averyfreight.com, our designated request address; we will record and honor it and answer within 60 days.
Canada and Quebec
If you are in Canada, you can ask to see and correct your personal information and withdraw your consent, subject to legal and contractual limits. We answer within 30 days. If we need more time, we may extend that once, by up to 30 more days, and we tell you within the first 30 days, with the new date, our reasons and your right to complain to the Office of the Privacy Commissioner of Canada (priv.gc.ca). You can complain to the Office of the Privacy Commissioner of Canada; a complaint about a refused access request is due within six months of the refusal. When you contact us for your business, we use your business contact information to communicate with you about that business.
If you are in Quebec, you also have the rights of access and rectification under Quebec’s Act respecting the protection of personal information in the private sector. Send access or rectification requests in writing, by email or mail, to our Privacy Officer. We answer in writing within 30 days of receiving your request, and a missing answer counts as a refusal. You can bring a disagreement to the Commission d’accès à l’information du Québec (cai.gouv.qc.ca) within 30 days of our answer, or of the date our answer was due. Apart from the Cloudflare security check on the quote and carrier setup forms, which stores data in your browser to tell people from bots, the Site runs no tool that identifies you, follows you across websites or builds a profile of you. For location, its cookieless visit counts keep only the country, region and city your IP address points to, together with the page, the page that sent you and your device and browser type, in a way designed not to identify you.
Our Privacy Officer, the Chief Executive Officer, is responsible for this policy and can be reached at support@averyfreight.com or (909) 918-5477. Your information is stored in the United States and may be processed in other countries where our service providers operate, where courts and authorities may be able to access it under local law.
Mexico
If you are in Mexico, you have the rights of access, rectification, cancellation and opposition (ARCO rights), and you can revoke your consent, under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties. Send your request to support@averyfreight.com with your name, how to reach you, the right you want to use, a description of the data (not needed for access) and a copy of an official ID (a representative also sends their own ID and proof of their authority). We answer within 20 business days and carry out an accepted request within 15 more (each period can be extended once when needed). If you disagree with our answer, you can file a request for protection of your data with Mexico’s Secretaría Anticorrupción y Buen Gobierno within 15 business days of our answer, or once our deadline has passed without an answer. Our privacy notice for Mexico, in Spanish, is our Aviso de privacidad.
Children
The Site is made for businesses and adults. It is not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we will delete it.
Where information is processed
AFL is based in the United States. Our service providers process information in the United States and in other countries where they operate. If you use the Site from outside the United States, your information is transferred to and processed in the United States.
Links to other websites
The Site links to websites run by others, such as the shipment-tracking portal, the FMCSA’s SAFER system, map directions and the privacy pages of the tools we use. Their own privacy policies apply there.
Changes to this policy
When we change this policy, we post the new version here with a new “Last updated” date and a short note at the top of this page that says what changed. A new optional tool stays off until you turn it on in the privacy banner, which appears as soon as the tool is added. Before we use information you already gave us in a materially different way, we ask for your consent.
